What is a Title Deed and What are Its Types?

The term "title deed" is familiar to anyone who wishes to own property. A title deed is an official document that proves ownership of real estate or structures built upon it. Issued by the Land Registry Directorate, these documents verify property ownership and contain all relevant information about the real estate. In Turkey, there are different types of title deeds, each with distinct colors. In this article, we will examine the types and colors of title deeds in Turkey in detail.

What is a Title Deed?

A title deed is an official document in Turkey that shows the ownership of real estate. The title deed is issued by the Land Registry Directorate and contains all information about the property. The title deed includes details about the land or building, the owner's identity, and the address of the property.

The title deed is the most important proof of property ownership, and the transfer of the title deed is carried out when purchasing real estate. The title deed is crucial for proving ownership and protecting property rights. Additionally, it is impossible to perform any transactions on real estate without a title deed.

Colors of Title Deeds:

In Turkey, title deeds come in two different colors and types: blue and pink.

Blue Title Deed:

The blue title deed represents land plots that have not yet been developed or newly started construction. This type of deed indicates that the property has not yet been converted to condominium ownership. Blue title deeds pertain to land plots without any structures or with newly begun construction. This deed shows the owner's ownership rights over the land.

Pink Title Deed:

The pink title deed indicates that the property's construction has been completed and there are approved independent sections in the project. This deed shows that the owner has an independent section and details the usage areas and shares of the property. Pink title deeds are issued for properties that have been converted to condominium ownership.

Types of Title Deeds:

In Turkey, there are three types of title deeds: condominium ownership, condominium servitude, and shared ownership.

Condominium Servitude Deed:

A condominium servitude deed is issued for buildings under construction. This deed type is prepared for buildings that are not yet completed or are under construction. It defines the shares on the land and indicates the areas allocated to right holders. Properties with condominium servitude deeds are registered with the Land Registry Office and have official status. Owners can use these deeds to obtain mortgage loans.

Condominium Ownership Deed:

A condominium ownership deed is issued for completed buildings where independent sections are individually registered. This deed is used to document the owner's independent ownership rights. The condominium ownership deed includes details about the building, independent section numbers, and common areas. This type of deed is most suitable for obtaining mortgage loans.

Shared Ownership Deed:

A shared ownership deed is issued for properties where ownership shares are indicated. This deed specifies the shares of the co-owners but does not define which part of the land belongs to whom. Properties with shared ownership deeds generally have lower value compared to other deed types. Selling these properties is more difficult, and obtaining a mortgage loan is not possible.

Acquiring a Title Deed in Turkey:

Acquiring a title deed is a process that a person who wants to buy real estate must go through. Before acquiring a title deed, it is important to obtain detailed information about the property's condition and the type of deed. The day of title deed acquisition is when the parties meet at the land registry office and the transfer of the deed is completed. After the acquisition, the title deed is delivered to the owner, and the ownership rights officially become valid.

Conclusion:

A title deed is an official document that shows the ownership of real estate in Turkey. There are two different colors of title deeds in Turkey: blue and pink. These include condominium servitude deeds, condominium ownership deeds, and shared ownership deeds. Each type of deed has different characteristics and usage areas.
